Some legal documents are effective only if they are signed in the right way. That may mean signing in the presence of a witness, initialing each page, attaching exhibits properly, having multiple signatories execute in a particular order, or following formal rules set by statute, lender requirements, court practice, or the document itself. When execution formalities are missed, the document may be delayed, challenged, or rejected altogether.

Many people assume that a signature alone is enough. In practice, the enforceability or acceptance of a document can depend on specific formalities. A lender may require a particular signature block. A corporate document may require an officer to sign in a defined capacity. A sworn document may need to be commissioned rather than simply witnessed. A will or power of attorney may require specific execution rules that should be followed carefully.

These terms are often used together, but they are not interchangeable. Witnessing a signature means observing the person sign and completing the witness portion of the document if required. Notarization adds a formal notarial certificate and may be required for domestic or international acceptance. Commissioning applies to sworn documents such as affidavits and declarations. Independent legal advice is something else again.
Understanding the difference matters because the receiving authority may reject the document if the wrong formal step is taken. If a client is unsure whether the document needs a witness, a commissioner, a notary, or a lawyer giving advice, we review the document and the surrounding instructions first.
Execution support is especially important for real estate and lending documents because these transactions often involve strict closing timelines and detailed signature requirements. A guarantee, direction, consent, or mortgage-related document that is improperly executed can delay funding or create last-minute closing issues. Even where the document was prepared by another law firm, lender, or private party, the signing formalities still need to be followed carefully.
We help clients approach these appointments in an organized way so that the document package is signed, witnessed, and completed correctly. If the document appears incomplete or the signing instructions are unclear, we flag that issue before the execution step is finalized.
Clients also use execution services for personal planning documents such as powers of attorney and related estate-planning materials. Proper execution is especially important here because the document may not be relied on until years later, often in a stressful circumstance involving illness, incapacity, or urgent decision-making. If execution is challenged at that stage, the consequences can be serious.
